Chapter 1 General Provisions
|
(Purpose)
Article 1
1. The purpose of this agreement is to stipulate necessary matters regarding the use of the infectious disease outbreak trend information visualization system operated by the Ministry of Health, Labour and Welfare.
(Definition)
Article 2
1. In this agreement, the definitions of the terms listed in the following items shall be as set forth in each of the following items.
(1) "This system" refers to an information system that creates data to evaluate infection trends by prefecture, shares information with local governments, and discloses information to the public in the "Basic Response Policy for Novel Coronavirus Infectious Disease Countermeasures" (March 28, Reiwa 2 (changed on May 14, Reiwa 2)).
(2) "System user" means a citizen who uses this system.
(3) "Administrative Agency Using the System" Administrative agencies that use this system to share and refer to information on infection trends, and administrative agencies that provide information within the scope of the purpose that the administrative agency deems appropriate.
(4) "System Provider" means the Ministry of Health, Labour and Welfare.
(5) "Login ID (account ID)" means a code assigned by the system provider to identify the Administrative Agency Using the System.
(6) "Password" means a code given by the system provider at the time of use of this system in order to identify the Administrative Agency Using the System.
(Applicable)
Article 3
1. These Terms of Use shall apply to System Users and the Administrative Agency Using the Systemrs
2. The System Provider may revise these Terms of Use without prior notice, and the revised Terms of Use shall apply to the use of the System after the effective date of the revised Terms of Use. In addition, the system provider shall make the revision of this agreement known through this system.

Chapter 2 Use of the System

(Consent to the Terms)
Article 4
1. When using this system, the system user and the administrative agency that uses this system shall read this agreement carefully in advance and agree to this agreement before using this system.
2. When the system user and the administrative agency using this system, the system user shall be deemed to have agreed to this agreement.
(System user)
Article 5
1. System users shall use this system based on their own responsibility and judgment, and shall not bear any responsibility to the system provider or the Administrative Agency Using the System.
2. System users shall comply with the terms and conditions regarding the use of the System posted on the System. The system provider and the administrative agency shall not be liable for any damages incurred by the system user or other third parties as a result of the system user's failure to comply with the matters related to the use of this system.
(Administrative Agency)
Article 6
1. Since the Administrative Agency Using the System is a national public servant and a local public servant, the information obtained by this system (hereinafter referred to as "acquired information") is used. The obligation to maintain confidentiality as stipulated in the National Public Service Act and the Local Public Service Act shall be strictly observed.
2. In the event that personal information exists in the information acquired from this system, the administrative agency shall protect the personal information in accordance with the relevant laws and regulations regarding the handling of information held by the administrative agency.
3. The Administrative Agency Using the System shall access the System using the login ID (Account ID) and password issued by the System Provider.
4. The Administrative Agency Using the System shall appropriately manage the login ID (Account ID) and password issued by the System Provider.
5. The Administrative Agency Using the System shall provide information listed in the following items that arise in connection with the use of this system and various communications (including electromagnetic records) generated during communication. and shall not bear any responsibility to the system provider.

(Intellectual Property Rights Related to the System)
Article 7
1. Intellectual property rights such as programs and other copyrighted works related to this system and the know-how contained therein belong to the system provider or IT service provider.
2. System Users shall comply with all of the following matters when handling programs and other copyrighted works related to the System and the know-how contained therein.
(1) To use the System only in accordance with these Terms of Use.
(2) Do not modify, edit, distribute, reverse engineer*, etc.

(Availability of the System, etc.)
Article 8
1. In principle, the system can be used by system users 24 hours a day, 365 days a year.
2. In principle, the system can be used 24 hours a day, 365 days a year. However, inquiries regarding the operation of this system shall be handled during the office hours of the administrative agency that uses the system.
3. Even within the above time, the use of this system may be suspended without notice to the system user due to equipment maintenance, etc.

Article 9
1. The format of the files acquired by the System User and the Administrative Agency Using the System when using the System shall be xls, xlsx, ppt, pptx, pdf, png, gif, jpg, jpeg, and bmp files. * It may vary depending on the content of the procedure.
2. In the event that a system user creates a derivative work using a file obtained from this system, they shall use it at there own risk in compliance with the Copyright Act and other related laws and regulations. In this case, the system provider and the administrative agency shall not be liable for any damages incurred by the system user or other third parties as a result of the system user's failure to comply with laws and regulations
3. In the event that the Administrative Agency Using the System creates a derivative work using the files obtained from this system, it shall use it at its own risk in compliance with relevant laws and regulations. In this case, the System Provider shall not be liable for any damages incurred by the Administrative Agency Using the System or other third parties as a result of the User's failure to comply with laws and regulations.
(Prohibited Matters)
Article 10
1. When using this system, the following acts are prohibited.
(1) Using or attempting to use this system for any purpose contrary to these Terms of Use.
(2) Using or attempting to use this system for purposes contrary to public order and morals, such as sending viruses or unauthorized access.
(3) Engaging in acts that violate relevant laws and regulations.
(4) Other acts that interfere with or may interfere with the management and operation of this system.

Chapter 3 Management of Systems, etc

(Preparation, etc.)
Article 11
1. The system user and the administrative agency that uses the system shall prepare all equipment (including software and communication means) necessary for using this system at their own expense. In that case, the necessary procedures shall be carried out by the system users at their own risk.
2. Communication costs necessary to use the System and all other expenses related to the use of the System shall be borne by the System User and the Administrative Agency Using the System.
(System Warranty, etc.)
Article 12
1. In the event of delay, interruption or suspension of the provision of the System, the System Provider and the Administrative Agency Using the System shall not be liable for any damages incurred by the System User or other third parties as a result.
(Modification and Deletion of Information, etc.)
Article 13
1. In principle, the right to modify or delete each registered information in this system shall belong to the system provider of this system who provided or registered the information.
However, in the future, if the function of modifying or deleting each registered information is provided by the Administrative Agency Using the System, the right to modify or delete the information shall, in principle, belong to the Administrative Agency Using the System that provided or registered the information and the system provider of this system.
(Restricted Use During Emergencies or High Demand)
Article 14
1. In the event of a natural disaster, incident, or other emergency, or a serious failure of the System or any other unavoidable reason, the System Provider may suspend or restrict the use of the System without prior notice to the System User.
2. In the event that the use of the System is significantly concentrated, the System Provider may restrict the use of the System to System Users without prior notice.
(System Failure Management)
Article 15
1. In the event of a failure of this system, the measures taken by the system user, the Administrative Agency Using the System, and the system provider shall be as follows.
2. The system user and the administrative agency that uses the system shall promptly grasp the occurrence of the failure and contact the system provider as necessary.
3. After receiving a notification of the occurrence of a failure from the system user and the Administrative Agency Using the System, the system provider shall contact the relevant system operation and maintenance business operator and others as needed to promptly restore the failure, and shall notify the system user and the Administrative Agency Using the System of the recovery status as necessary.
4. After the failure is restored, the system provider shall conduct a failure analysis, strive to prevent the occurrence of similar failures, and implement necessary improvement measures.
(Other)
Article 16
1. In addition to what is stipulated in this agreement, the system provider shall contact the system user and the Administrative Agency Using the System on a case-by-case basis based on the intentions of the system user and the Administrative Agency Using the System regarding matters necessary for the smooth implementation of this system.

These Terms and Conditions shall come into effect from the date of commencement of operation of the Infectious Disease Outbreak Trend Information Visualization System.
